Supreme Court Uses Article 142 to Grant MBBS Seat to EWS Candidate

The Supreme Court of India said that just because the Economically Weaker Section reservation policy is not being used does not mean a good student should not get into a medical college for an MBBS course. The Court said that if a student has already done well on the exam and meets the requirements for the Economically Weaker Section category the government or other authorities cannot use their slow pace as an excuse to keep the student out.

 

This case was a student from the Economically Weaker Section category who did well on the NEET exam.. The student could not get into a private medical college because the people in charge had not implemented the Economically Weaker Section reservation policy on time. So the seats that were supposed to be saved for Economically Weaker Section students were not available when it was time to pick students.

 

When the Supreme Court of India heard about this they said it would not be fair to punish the student for the mistakes of the government or other authorities. The judges said that students should not be hurt by the pace of the government or gaps in policies. The Court also said that reservation policies are meant to give everyone the chance and if they are not used correctly good students can get hurt.

 

To be fair and give the students what they deserved the Supreme Court of India used a power they have under Article 142 of the Constitution of India. This power lets the Court make decisions that’re necessary to be fair even if they are unusual. Using this power the Court told the people in charge to give the student a spot in an MBBS course under the Economically Weaker Section category in a medical college.

 

The Court also reminded the government and the people who oversee education that they have to implement reservation policies on time. If they do not it can cause confusion when students are being picked and might keep students from getting what they deserve.

 

The Supreme Court of India made it clear that the government cannot let their slow pace hurt the future of students. This decision reinforces the idea that the education system has to be fair and that the people in charge have to make sure reservation policies are used so good students get what they deserve from the Economically Weaker Section reservation policy and the education system. The Supreme Court of India wants to make sure that the Economically Weaker Section reservation policy is used to help students from the Economically Weaker Section category.
